By using ListingToolkit, you agree to these Terms of Service. ListingToolkit is operated by Verso Lab LLC, DBA Listing Toolkit. Please read these terms carefully.
The Service is intended for lawful professional use by licensed real estate agents, brokers, and related professionals. Users must be at least 18 years old and have the authority to bind any entity they represent.
To access certain features, you may need to create an account by providing accurate and current information (name, email address, etc.). You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You may use the Service solely for generating real estate listing descriptions, marketing materials, and related professional content. You must not use the Service for any unlawful, discriminatory, or fraudulent purpose.
You retain all rights to any content you input into the Service. You grant ListingToolkit a worldwide, royalty‑free, non‑exclusive license to host, store, transmit, and display your content solely to provide and improve the Service.
All software, algorithms, designs, trademarks, and other proprietary materials provided by ListingToolkit remain the exclusive property of Verso Lab LLC or its licensors.
Outputs generated by artificial intelligence are provided “as is” for your professional use. You are solely responsible for reviewing, editing, and verifying all AI‑generated content before publication, including compliance with fair housing laws, local regulations, and your MLS’s rules. ListingToolkit does not guarantee the accuracy, completeness, or legal compliance of such outputs.
You must ensure that any content generated through the Service does not violate the Fair Housing Act or any equivalent state or local anti‑discrimination laws. ListingToolkit is not liable for any violations resulting from your use of AI‑generated content.
You are responsible for ensuring that any listing content adheres to the specific rules and regulations of your Multiple Listing Service (MLS). ListingToolkit does not monitor or enforce MLS requirements.
You may not: (a) reverse engineer, decompile, or disrupt the Service; (b) use the Service to send spam, malware, or harmful code; (c) collect personal data from other users without consent; or (d) impersonate any person or entity.
Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference.
If applicable, you agree to pay any fees associated with your selected plan. All fees are non‑refundable unless otherwise stated. Payment failures may result in suspension or termination of your account.
These Terms remain in effect until terminated by either party. You may terminate your account at any time via your account settings. ListingToolkit may suspend or terminate access for violations of these Terms, illegal activity, or upon 30 days’ notice for convenience.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non‑infringement.
To the maximum extent permitted by law, Verso Lab LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service.
You agree to indemnify, defend, and hold harmless Verso Lab LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Any legal action shall be brought exclusively in the state or federal courts located in Denver, Colorado.
We may revise these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
